Terms of Service

These Terms of Service govern your use of NerdWear.net and your purchase of products from NerdWear. By accessing this website, placing an order, or otherwise using our services, you agree to these Terms of Service.

If you do not agree to these terms, please do not use the website or place an order.

1. NerdWear Products

NerdWear sells made-to-order embroidered products featuring pre-designed NerdWear Expressions and predetermined embroidery specifications.

Product photographs, descriptions, colors, dimensions, and other information are provided to help customers make purchasing decisions. Because computer and mobile displays vary, actual product colors may differ slightly from those shown on screen.

Minor variations may also occur as a normal result of embroidery and on-demand production.

2. Orders

By submitting an order, you represent that the information you provide is accurate and that you are authorized to use the payment method submitted with the order.

NerdWear reserves the right to refuse, cancel, or limit an order when reasonably necessary, including in cases involving:

Suspected fraud or unauthorized payment
Incorrect pricing or product information
Product or fulfillment availability
Shipping restrictions
Technical or system errors
Violation of these Terms of Service

If NerdWear cancels an order after payment has been collected, an appropriate refund will be issued.

3. Made-to-Order Production

NerdWear products are produced specifically for individual orders.

Production does not necessarily begin immediately when an order is submitted. Orders may be reviewed before being released for fulfillment.

Once production has begun, changes or cancellations may no longer be possible.

Please review all product selections, colors, shipping information, and other order details carefully before completing checkout.

4. Prices

Prices are displayed in the currency shown at checkout and are subject to change without notice.

A price change does not affect an order that has already been properly submitted and accepted, except when an obvious pricing or technical error has occurred.

Applicable shipping charges, taxes, duties, and other charges will be displayed or calculated where appropriate.

5. Payments

Payment must be successfully authorized or collected before an order is processed for fulfillment.

NerdWear uses third-party payment processors to process transactions. NerdWear does not directly store complete payment-card information submitted through Shopify checkout.

Payment processing may also be subject to the terms and policies of the applicable payment provider.

6. Shipping and Delivery

Orders require production time before shipment.

Shipping and delivery estimates are estimates only unless NerdWear expressly states otherwise in writing.

NerdWear is not responsible for delays caused by shipping carriers, severe weather, transportation disruptions, customs processing, incorrect shipping information supplied by the customer, or other circumstances outside our reasonable control.

Shipping is subject to the NerdWear Shipping Policy, which is incorporated into these Terms of Service.

7. Returns, Refunds, and Cancellations

Because NerdWear products are made to order, returns and exchanges are limited.

NerdWear does not generally accept returns or exchanges for buyer's remorse, change of mind, incorrect color selection, or other customer ordering errors.

Damaged, defective, misprinted, incorrect, or lost orders may qualify for replacement or refund as described in our Return, Refund & Cancellation Policy.

The NerdWear Return, Refund & Cancellation Policy is incorporated into these Terms of Service.

8. Customer Information

You are responsible for providing accurate and complete information when placing an order.

This includes your:

Name
Email address
Billing information
Shipping address
Product selections

NerdWear is not responsible for losses or additional costs resulting from incorrect information supplied by the customer.

9. Website Use

You may use NerdWear.net only for lawful purposes.

You may not:

Attempt to interfere with the operation or security of the website
Introduce malicious software or harmful code
Attempt unauthorized access to accounts, systems, or data
Use automated systems to disrupt or abuse the website
Use the website for fraudulent or unlawful activity
Misrepresent your identity or payment authority

NerdWear may restrict access to the website when reasonably necessary to protect customers, the business, or its systems.

10. Intellectual Property

Unless otherwise stated, the NerdWear name, NerdWear.net name, website design, original graphics, product designs, product descriptions, photographs, branding, logos, and other original NerdWear content are owned by or licensed to NerdWear and are protected by applicable intellectual-property laws.

Purchase of a NerdWear product does not transfer ownership of any underlying design, artwork, branding, or intellectual property.

You may not reproduce, manufacture, distribute, sell, commercially exploit, or create unauthorized derivative products using NerdWear-owned designs or branding without permission.

References to mathematical, scientific, engineering, computing, or other factual expressions do not constitute a claim of ownership by NerdWear over facts, equations, scientific principles, or other material that is not legally subject to exclusive ownership.

11. Third-Party Services

NerdWear uses third-party providers to operate portions of the business, including ecommerce, payment processing, manufacturing, fulfillment, and shipping.

These providers may include Shopify, Printful, payment processors, and shipping carriers.

NerdWear is not responsible for independent third-party services beyond the extent required by applicable law.

12. Product Availability

Products, colors, materials, embroidery options, and styles may be changed, discontinued, or temporarily unavailable without notice.

NerdWear does not guarantee that any particular product or variation will remain available indefinitely.

13. Materials, Sensitivities, and Allergies

NerdWear products may contain natural or synthetic fibers, dyes, embroidery thread, metal components, finishes, or other materials commonly used in hats and apparel accessories.

Product material information is provided on the applicable product page when available. Customers with known allergies, skin sensitivities, or sensitivities to particular fibers, metals, dyes, finishes, or other materials are responsible for reviewing the available product information before purchasing or wearing an item.

Individual reactions to materials vary, and NerdWear cannot guarantee that a product will be suitable for every individual or free from substances that may cause sensitivity or irritation in a particular person.

If you experience irritation, discomfort, rash, or another adverse reaction while using a NerdWear product, discontinue use.

To the extent permitted by applicable law, NerdWear is not responsible for allergic reactions, skin sensitivities, or other individual reactions to materials that are accurately identified or ordinarily used in the product.

Nothing in this section limits any rights or remedies that cannot legally be waived, including rights relating to defective or unsafe products.

14. Errors and Inaccuracies

We make reasonable efforts to keep product information, pricing, descriptions, and other website information accurate.

However, errors may occasionally occur.

NerdWear reserves the right to correct typographical errors, inaccuracies, omissions, pricing errors, and other mistakes, including after an order has been submitted.

If a material error affects an order, NerdWear may contact the customer, correct the order when possible, or cancel and refund the affected transaction.

15. Disclaimer of Warranties

To the extent permitted by applicable law, NerdWear products and services are provided on an "as available" basis.

NerdWear does not guarantee that the website will operate without interruption or that every website feature will always be available.

Nothing in this section limits warranties or consumer rights that cannot legally be excluded.

16. Limitation of Liability

To the maximum extent permitted by applicable law, NerdWear will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website, delayed delivery, inability to use the website, or purchase of a product.

For claims relating directly to a NerdWear purchase, NerdWear's liability will generally not exceed the amount paid for the product giving rise to the claim, except where applicable law requires otherwise.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

17. Privacy

Use of NerdWear.net is also subject to our Privacy Policy.

The Privacy Policy explains how personal information may be collected, used, processed, and shared in connection with the website and your purchases.

18. Changes to These Terms

NerdWear may update these Terms of Service from time to time.

Changes will become effective when the revised Terms are posted on the website unless otherwise stated.

Your continued use of the website after revised Terms become effective constitutes acceptance of the revised Terms.

These Terms of Service and transactions with NerdWear will be governed by the laws of the State of Texas and applicable federal law, without limiting any consumer rights that must apply under the laws of another jurisdiction.

20. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

21. Entire Agreement

These Terms of Service, together with the Privacy Policy, Shipping Policy, Return, Refund & Cancellation Policy, and other policies displayed at checkout or on NerdWear.net, constitute the agreement governing your use of the store and purchases from NerdWear.
